Terms of Service

Interpretation
In this Agreement, clause headings are for convenience and shall not affect interpretation. Unless context indicates otherwise:

  • Customer means any person on whose behalf the Company supplies goods or services.

  • Company means Phaahleng Buildtech, supplying and installing goods or services.

  • Goods means any materials, products or services supplied by the Company.

  • Agreement/Contract means this document and any additional written terms agreed between the parties.

  • Parties means the Company and the Customer.

  • Signature date means the date on which the quote is signed and accepted.


Design Terms

Payments

  • A minimum 30% deposit of the quoted price is required before work begins; the balance is invoiced on completion.

  • If municipal approval is needed, a 30% commitment fee is required, then another 30% to start the approval process; the remaining 40% is due on project completion.

  • Any alternative payment arrangement must be agreed in writing.

  • Meeting these terms constitutes acceptance of the work; additional work beyond this scope is charged separately.


Final Work

  • No final deliverables will be produced until full payment is received.

  • You will only see watermarked drawings, images, or video samples as work-in-progress.

  • Resold plans are sold “as-is” with only client details updated; any other revisions are treated as a new project and billed accordingly.

  • Quoted prices may change if alterations are requested during the project.


Quotation

  • We charge per square metre and per service; prices may increase or decrease based on:

    • Changes to area (addition/removal of rooms)

    • Overall design revisions

    • Addition or removal of services

  • Price changes requested by the client will adjust the outstanding invoice accordingly; changes by the provider incur no client cost without consent.


Printing and Delivery

  • An optional printing and delivery fee applies; it becomes compulsory when municipal approval is part of the package.


Ownership

  • All work produced remains the Company’s intellectual property, except technical drawings (the client owns those).

  • Other media (renders, presentations) remain at the Company’s discretion.


Agreement

  • These terms apply to every agreement between the Company and the Customer.

  • Any payment before work commencement implies acceptance of these terms.

  • Extra fees outside the quotation (municipal fees, professional services) are payable by the client.

  • The Company may suggest third-party service providers, but the client is responsible for their fees.

  • Quotations are obligation-free; the client may cancel at any time, but deposit forfeit conditions apply:

    • If work is terminated after deposit, the deposit is forfeited.

    • Terms cease when the client terminates or final work is accepted and delivered.


Call-Out Fees

  • Applicable for distances over 50 km from the registered business address, charged at R9.00 per km, in 50 km increments.

  • Applies to as-built surveys and plan redraws regardless of distance.


Data Consent

  • By requesting a draft or quote, you consent to having your personal information retained for email/SMS marketing.

  • You may request data deletion at any time.


Termination Rights

  • The Company may terminate the Agreement at its sole discretion; in such event, the client may claim the paid commitment fee only.


Risks & Scope

  • We are not registered architects. Services are limited to drafting and documentation under the Architectural Profession Act 2000 (Act 44 of 2000).

  • Services include:

    • Conceptual designs

    • Technical drafting

    • Submission drawings

    • 3D visualisations

    • Municipal submission assistance

  • Clients are advised to appoint a registered architect for compliance, sign-offs, and SANS calculations.

  • By engaging us, you acknowledge our role is that of a draughtsman/technical provider; you remain responsible for regulatory and professional compliance.


Construction Terms

Quotations

  • A quotation is an invitation to do business, not an offer.

  • The Company may revoke a quote at any time.

  • Orders not accepted within 10 working days are deemed withdrawn.

  • A contract forms once the Customer signs and pays the initial deposit.

  • Quotes are based on current exchange rates, freight, insurance, labour, materials, duties, taxes, and may be adjusted for changes.

Separate Agreements

  • Each signed quotation constitutes a separate agreement incorporating these terms.

  • Additional work requires a written change order and new quote.

  • In conflicts, these terms take precedence over the quotation.

Purchase Price & Payment

  • The total price is as specified in the quotation.

  • Quotes are valid for 15 days and subject to revision for material or fee increases.

  • Discounts apply only if payment is made by the due date.

  • The Company may cancel the Agreement and refuse further delivery; the client has no claim against the Company in such cases.

  • Final payment is due within 7 days of each stage’s completion and sign-off; overdue balances incur interest at prime + 2.5% per month.

  • Clients should set aside contingency funds for unforeseen circumstances.

Special Conditions

  • Installation times depend on site conditions and industry breaks.

  • Uninterrupted 230/400 V mains power is required; generator hire (R650/day) is available if needed.

  • Unrestricted site access and toilet facilities must be provided free of charge.

  • No work begins until approved drawings and deposit proof are received.

  • Special-made items are non-refundable.
